1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Car Inspecta website https://carinspecta.com.au and services provided by Car Inspecta. By accessing or using our website and services, you agree to comply with and be bound by these Terms.

2. Services Provided

Car Inspecta provides pre-purchase car inspection services. The inspection report is based on a visual assessment and does not involve dismantling parts of the vehicle.

3. Booking and Payment

Booking: Inspection bookings can be made via our website. You must provide accurate details about the vehicle and its location.
Payment: Payment is required at the time of booking. We accept various forms of electronic payment as indicated on our website.

4. Inspection Process

Scope: The inspection includes a visual assessment of the vehicle’s interior, exterior, engine bay, tyres, wheels, brakes, and a road test.
Limitations: The inspection does not cover mechanical or technical systems not accessible without dismantling parts of the vehicle. Inspections are based on visible and accessible areas only; we do not remove parts or use invasive methods to inspect internal components.

5. CarFacts History Report

Inclusion: Each inspection includes a CarFacts History Report providing data on (but not limited to) finance owing, PPSR, written-off status, registration status, stolen status, and odometer roll-back.
Accuracy: The CarFacts History Report is compiled from third-party data, and Car Inspecta does not guarantee its accuracy.

6. What We Don’t Inspect/Exclusions

Exclusions: We do not inspect internal engine components, transmission, differentials, or any part requiring dismantling to access. Additionally, we do not cover electrical systems, air conditioning efficiency, or LPG systems. Our inspections are limited to what is visible and accessible during a Comprehensive inspection.

7. Customer Obligations

Accuracy: Customers must provide accurate and complete information about the vehicle and its location.
Access: Ensure the vehicle is accessible at the scheduled inspection time. Failure to provide access may result in additional fees or rescheduling.
Payment: Ensure payment is completed at the time of booking to confirm the inspection appointment.

8. Road Test

Insurance Requirement: A road test can only be conducted by the inspector if the seller’s vehicle is insured.
Alternative Option: Alternatively, the seller can drive the car while the inspector is in the passenger seat.

9. Car Inspecta Report

Report Contents: The Car Inspecta Report includes findings from the visual inspection and the CarFacts History Report. It provides a detailed overview of the vehicle’s condition based on the inspection scope.
Limitations: The report is not a recommendation to buy or not buy a vehicle. It is a tool to help customers make informed decisions.

10. Definitions

Seller: The person or entity offering the vehicle for sale.
Buyer: The person or entity considering the purchase of the vehicle and who requests the inspection service.

11. Social Media Policy

Conduct: Users must not post false, defamatory, abusive, or harassing comments about Car Inspecta on social media platforms.
Sharing: Users may share their inspection experiences and Car Inspecta reports on social media, provided the content is accurate and not misleading.

12. Fees, Refunds, and Cancellations

Fees: All fees for inspection services are clearly listed on our website. Additional charges may apply for services outside the standard inspection scope.
Refunds: Refunds are processed for cancellations made more than 24 hours before the scheduled inspection. Refunds will be issued to the original payment method within 5-7 business days.

Cancellations: Cancellations made within 24 hours of the scheduled inspection are not eligible for a refund. Rescheduling is possible but may incur additional fees if done within 24 hours of the inspection.
PPSR: Car Inspecta will conduct a Personal Property Securities Register (PPSR) check on your prospective vehicle to ensure it is free from debt, has not been written off, and is not reported as stolen. Should any of these issues be identified, we will inform you prior to proceeding with the inspection. This process is designed to save you both time and money. If any issues are found, you will have the option to either inspect another vehicle or receive a refund. Please note, a fee of $10 will be deducted from your refund to cover the cost of the PPSR check and associated administrative expenses.

13. Limitation of Liability

Car Inspecta is not liable for any indirect, incidental, or consequential damages arising from the inspection service. Our total liability is limited to the amount paid for the inspection service.

14. Complaints

Process: Complaints must be submitted via a Complaints Form. Car Inspecta will review the inspection report and, if necessary, provide the mechanic’s details for further resolution.
Refunds: If the report does not comply with Australian Consumer Law, Car Inspecta will refund the cost of services, and the complaint will be considered resolved.

15. Intellectual Property

All content on the Car Inspecta website, including text, graphics, logos, and images, is the property of Car Inspecta or its content suppliers and is protected by copyright laws. You may not reproduce, distribute, or create derivative works from any content on this website without our prior written permission.

16. Privacy

Your use of our website and services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.

17. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Victoria.

18. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date.
